1. AGREEMENT TO TERMS

By accessing or using khalani.co ("Website"), you agree to be bound by these Terms of Service. If you disagree with any part of these terms, you may not access the Website or purchase our products.

2. ELIGIBILITY

You must be at least 18 years old to make purchases. By placing an order, you confirm you meet this requirement and that all information provided is accurate.

3. PRODUCTS & PRICING

Product Descriptions: We strive for accuracy in all product descriptions, colors, and measurements. However, slight variations may occur due to handwork nature and screen display differences.

Pricing: All prices are in USD and subject to change without notice. The price at the time of order confirmation is final.

Availability: Products are subject to availability. We reserve the right to limit quantities or discontinue any product.

4. ORDERS & PAYMENT

Order Acceptance: Your order is an offer to purchase. We reserve the right to accept or decline any order for any reason.

Payment: Full payment is required at time of order unless otherwise agreed in writing. We accept all major credit cards. Payment processing is handled securely through our encrypted payment processor.

Custom Orders: Custom and made-to-order pieces require 50% deposit at time of order, with remaining balance due before shipment.

5. SHIPPING & DELIVERY

Processing Time: Ready-to-wear items ship within 3-5 business days. Custom orders require 8-12 weeks production time for bridal pieces and 4-6 weeks for formal wear.

Shipping: We ship via DHL, FedEx, UPS, and SkyNet. Risk of loss passes to you upon delivery to carrier.

International Orders: Customer is responsible for all customs duties, taxes, and fees.

Delays: We are not liable for shipping delays caused by carriers, customs, or circumstances beyond our control.

6. FORCE MAJEURE

Khalani Couture is not liable for delays or failure to perform due to circumstances beyond our reasonable control, including but not limited to:

  • Natural disasters, fires, floods, earthquakes
  • War, terrorism, civil unrest, or political instability
  • Labor disputes, strikes, or workforce shortages
  • Supplier delays, material shortages, or manufacturing disruptions
  • Government actions, regulations, or restrictions
  • Pandemics, epidemics, or public health emergencies
  • Power outages, internet failures, or technology disruptions
  • Transportation delays or carrier issues

In such events, production timelines may be extended without penalty, and we will notify affected customers as soon as reasonably possible. Orders may be cancelled with full refund if delays exceed 90 days beyond original estimated completion date.

7. RETURNS & EXCHANGES

Ready-to-Wear: Returns accepted within 7 days of delivery for unworn, unaltered items with original tags attached. Customer pays return shipping. 20% restocking fee applies.

Custom/Made-to-Order: All sales final. No returns or exchanges on custom pieces.

Damaged/Defective Items: Report within 48 hours of delivery with photographic evidence. We will repair, replace, or refund at our discretion.

8. ALTERATIONS & MEASUREMENTS

Customer is responsible for providing accurate measurements for custom orders. We are not liable for fit issues resulting from incorrect measurements provided by customer.

9. COLOR ACCURACY

Due to the handmade nature of our garments and variations in fabric dye lots, slight color variations may occur between the product image and the actual item. Colors may also appear different on various screens and devices. We cannot guarantee exact color matching.

10. PHOTOGRAPHY & CONTENT USAGE RIGHTS

Customer Content: By purchasing from Khalani Couture and sharing photos or videos of yourself wearing our products on social media, tagging us, or sending us content directly, you grant Khalani Couture a perpetual, royalty-free, worldwide, non-exclusive license to use, reproduce, modify, publish, and display such content for marketing, promotional, and commercial purposes across all platforms including but not limited to:

  • Website and e-commerce platforms
  • Social media (Instagram, TikTok, Facebook, Pinterest, etc.)
  • Email marketing campaigns
  • Print materials, advertisements, and catalogs
  • Trade show displays and promotional materials

Opt-Out: If you do not wish for your content to be used, please email info@khalani.co with your request, and we will honor it within 10 business days.

Professional Photography: When purchasing custom or bridal pieces, you may be invited to participate in professional photography sessions. Participation is voluntary. If you agree to participate, you grant the same usage rights as described above. You will be provided specific consent forms prior to any professional shoot.

Attribution: We will make reasonable efforts to credit you when using your content, but are not obligated to do so.

Representation: By submitting content, you confirm you have the right to grant these permissions and that the content does not violate any third-party rights.

11. INTELLECTUAL PROPERTY

All content on this Website—including designs, images, text, logos, and patterns—is owned by Khalani Couture and protected by copyright and trademark laws. Unauthorized use, reproduction, or distribution is strictly prohibited.

12. PROHIBITED CONDUCT

You may not:

  • Use the Website for any unlawful purpose
  • Attempt to gain unauthorized access to our systems
  • Copy, reproduce, or distribute our designs or content
  • Engage in fraudulent activity or chargebacks without legitimate cause
  • Resell our products without written authorization

13. LIMITATION OF LIABILITY

Khalani Couture is not liable for:

  • Indirect, incidental, or consequential damages
  • Damages exceeding the amount paid for the product
  • Issues arising from improper care or alterations
  • Third-party service failures (shipping, payment processing)
  • Special occasion missed deadlines due to shipping delays
  • Force majeure events or circumstances beyond our control

14. INDEMNIFICATION

You agree to indemnify Khalani Couture against any claims arising from your violation of these Terms or misuse of our products or Website.

15. MODIFICATIONS

We reserve the right to modify these Terms at any time. Changes become effective upon posting. Continued use of the Website constitutes acceptance of modified Terms.

16. GOVERNING LAW

These Terms are governed by the laws of the State of Texas, United States, without regard to conflict of law provisions. Any disputes will be resolved in the courts of Texas.

17. DISPUTE RESOLUTION

Any dispute arising from these Terms or your use of the Website shall be resolved through binding arbitration in accordance with Texas law, except where prohibited.

18. SEVERABILITY

If any provision is found unenforceable, remaining provisions remain in full effect.
